How the Combat Sports Authority of NSW (the “Authority”) handles your personal information when you make an application to apply for, amend, replace or renew registration under the Combat Sports Act 2013 (NSW) (the “Act”).

1. Who we are

Your information is being collected by the NSW Office of Sport, on behalf of the Authority. The NSW Office of Sport provides secretariat and administrative support to the Authority under a service level agreement.

We are partnering with Service NSW who act as a digital shopfront for Office of Sport. Your MyServiceNSW Account will be used to initiate your application.

We are also partnered with Digital NSW (part of the Department of Customer Service).

2. Why we are collecting your information 

The Authority regulates combat sports in accordance with the Act and the Combat Sports Regulation 2014 (NSW) (the “Regulation”). Individuals must be registered under the Act to engage or participate in combat sports, unless they satisfy a legislative exemption.

We collect personal information for the purposes of assessing applications to apply for, amend, replace or renew registration, and to generally administer the Act and the Regulation.

3. The kinds of information we collect 

We may collect the following personal and health information, either directly from you as part of the application process or indirectly in order to assess your application and for compliance purposes: 

  • identifying information such as your full name (or previous name), date of birth, gender and contact details (address, email and phone number);
  • proof of identity documents and information, which may include your passport, driver licence, Medicare card;
  • information about your fitness to compete in combat sports;
  • information about your capability to transmit any medical condition or disease specified by the Act or the Regulation; and
  • your criminal history (if any) and other compliance history held by government or sporting organisations.

Individuals who apply for registration as a combatant, industry participant or promoter (‘Applicants’) may be required to provide any or all of the personal and health information listed above. We are authorised to collect this information under section 11 or 23 of the Act respectively.

Legal guardians of Applicants who are under 18 years of age at the time of application who will receive the benefit of registration will not be required to provide health information as listed above (i.e. information about their fitness to compete in combat sports).

Provision of information to the Authority by yourself as an individual is voluntary.  If you fail to provide some or all of your personal or health information, your application may not be considered, or it may be refused in accordance with sections 11 or 23 of the Act as relevant.

You are required to inform the Authority of changes to your contact details and other personal information. Information on how to notify the Authority of changes is available on the Authority’s website.

3.1. MyServiceNSW Account 

Service NSW will collect and use the personal information you provide through your MyServiceNSW Account to verify your identity and confirm your current contact details.  With your consent, Service NSW will share some of this information with us, Digital NSW and the Department of Customer Service to process and receive your application.

Your MyServiceNSW Account is used to:

  • initiate your application using your MyServiceNSW Account details; and
  • verify your identity with the Document Verification Service.

Information that you provide when you make an application to apply for, amend, replace or renew registration is not collected or stored by Service NSW.

4. How we collect information

Generally, we collect personal information directly from you over the phone, over the internet, or in writing when you submit an application or update your details or information.  

There may be occasions where it is necessary to collect information from a third party. For example, we will need to collect information from a third party when we verify your proof of identity documents with the document issuer via the Document Verification Service.

5. How we use the information we collect

We may use the information we collect to:

  • assess your application;
  • manage your registration;
  • assess your eligibility to continue to be registered;
  • publish certain information on the Combat Sports Public Register;
  • otherwise generally administer the Act and the Regulation; and
  • improve the services we deliver.

6. Who we share information with

We will not disclose your personal information to anybody else, except the intended recipients of the information:

  • as outlined in this Notice; or
  • where required to fulfil the purposes outlined in this Notice; or
  • where you have given consent; or
  • where we are authorised to do so by law.

In order to assess your application, we may share some of your personal information in the following circumstances:

  • with the document issuer of your proof of identity documents
  • with the Commissioner of NSW Police, for the purposes of determining your application or eligibility to remain registered;
  • with registered promoters, managers, matchmakers and approved amateur bodies, where required to facilitate combat sports contests; and
  • with an equivalent Australian regulatory body, National Sporting Organisation or interstate organisation that is the equivalent of a NSW approved amateur body.

6.1. Office of Sport

The NSW Office of Sport provides secretariat and administrative support to the Combat Sports Authority of NSW under a service level agreement. This includes, under delegation from the Authority, receiving and determining applications for registration under the Act.

6.2. Public Register

Under clauses 7B and 19A of the Regulation, the following information will be published by the Authority on the Combat Sports Public Register:

  • Registration holder name
  • Registration holder ring name*
  • Registration number, class(es), expiry date, status
  • Eligible to fight to date*
  • Corporation name*
  • Registration Nominated Person name*
  • Any conditions imposed on a person’s registration*.
    *where applicable

6.3. Department of Customer Service

We are partnered with Digital NSW (also part of the Department of Customer Service) who assist us with our business operations by providing software and storing data on our behalf. Digital NSW have a Privacy Statement which outlines how they look after this data.

7. Protecting your information

We have measures in place to help protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.

We will store and manage your personal information in accordance with provisions under the Privacy and Personal Information Protection Act 1998 (NSW) and Health Records and Information Privacy Act 2002 (NSW). 8. Your rights

Subject to certain conditions, you have the following rights in relation to your personal information:

  • the right to access your personal information; and
  • the right to correct your personal information.
